CHROMA PHOTOBOOTH PRIVACY POLICY

Protecting your privacy is very important to us.  Accordingly, this Privacy Policy outlines the information that Chroma Photobooth (“Chroma” or “we”) collects from visitors (“you”) to our website and how that information will be collected, stored or used.  By using our website, you accept and consent to the policies and practices described in this Privacy Policy.

Chroma reserves the right to change this Privacy Policy at any time by posting a new or updated privacy policy.  We recommend that you review the current version of our Privacy Policy (which is available through a link on our website) periodically for changes.  Your continued use of this website after any change in this Privacy Policy will constitute your acceptance of such change.

INFORMATION WE COLLECT

In order to enhance your experience and provide you with better services, we may track certain information that is non-personally-identifiable when you visit our website.  Data is collected in aggregate and anonymously, which may include the type of Internet browser you are using, the type of computer operating system you are using, the pages you visited on our website, and how you arrived at our website. Chroma also has access to your IP address, which is not connected to any personally-identifiable information. Chroma may also collect personally-identifiable information that you voluntarily provide to us, including through an inquiry (such as name, email address, and phone number), or a questionnaire (such as email, name, phone number, and physical address), which we use in order to provide you with particular services offered through our website.  If you make a purchase online, a third party company, Stripe, will collect personal information from you in connection with your purchase; Chroma only receives your name and last four digits of your credit card number as a result of your purchase. If you make a purchase by phone, we will collect personal information from you in connection with the purchase. This information includes payment information, such as your credit or debit card number and other card information; other account and authentication information; and billing, shipping, and contact details.

USES OF INFORMATION WE COLLECTED

The main purpose for collecting personal information is to provide and improve our services.  Chroma does not presently use IP addresses for any reason, but reserves the right to use them in order to help us improve our services and website.  We also may use your non-personal information (including personal information that has been de-identified and/or aggregated) for any reason at our sole discretion.  We use your contact data to send you information about our services, pricing, and promotions, and to contact you when necessary. In any case, whether you submit such personally-identifiable information (including contact information) to us is wholly at your option.  If at any time you decide that you no longer wish to receive communications from us, please follow the Opt-Out procedure described in this policy below.

COOKIES

A cookie is a small file stored on your computer that contains anonymous information about your Internet use.  Usage of a cookie does not result in any personally-identifiable information about you being made available solely as a result of your having visited our websites.  Cookies are also used to measure usage of various pages on our website to help us make our information more pertinent to your needs and easy for you to access, and they provide functionality that we believe would be of interest and value to you.

You may set your browser to block cookies (consult the instructions for your particular browser on how to do this), although doing so will adversely affect your ability to perform certain transactions, use certain functionality and access certain content on our websites.

BROWSING

We do not collect personally-identifiable information from your computer when you browse our website and request pages from our servers.  Unless you voluntarily provide us with personally-identifiable information, we will not know your name, your email address, or any other personally-identifiable information.

INFORMATION SECURITY AND STORAGE OF INFORMATION

We are very concerned with safeguarding your information and have adopted reasonable and appropriate security procedures to help protect against loss, misuse, and unauthorized access to the information you provide to us.  All information that we collect through our website is stored under password protection to block unauthorized access from outside of Chroma. Information collected on the website covered by this statement is generally processed and stored in the United States.

SHARING OF INFORMATION

Chroma may provide your personal information to select third parties as we deem appropriate in the following limited circumstances: (1) to enforce our terms of use to which users are bound when they use our website; (2) to protect and defend the rights or property of Chroma; (3) to comply with a court order or other legal process or other legal requirements of any governmental authorities; or (4) to governmental authorities, in the sole discretion of Chroma, in exceptional circumstances, such as a national emergency, security concern, or other situation in which Chroma deems such disclosure prudent.

E-MAILS ABOUT SPECIAL OFFERS/PROMOTIONS AND OPT-OUT

It is our intention to send you only e-mail communications that will be useful to you and that you want to receive.  These communications may relate to Chroma offers or services. When you receive an e-mail, you will be provided the choice to opt-out of future e-mails by following the instructions provided in the e-mail.

SOCIAL NETWORKING SITES

Chroma may at some point work with certain third-party social media providers to offer you their social networking services through our services.  For example, you may be allowed to use third-party social networking services, including but not limited to Facebook, Twitter, and others to share information about your experience on our services with your friends and followers on those social networking services.  These social networking services may be able to collect information about you. These third-party social networking services also may notify your friends that you are a user of our services or about your use of our services, in accordance with applicable law and their own privacy policies.

YOUR CALIFORNIA PRIVACY RIGHTS

California law requires certain businesses to respond to requests from California residents asking about the disclosure of personal information to third parties for third party marketing purposes. Alternately, such businesses may adopt a policy of not disclosing personal information to third parties for marketing purposes if a California resident has opted-out of such information-sharing. At this time, Chroma does not share personal information with third parties for their marketing purposes.  If this changes, Chroma will inform you, and provide an opt-out option. At that time, if you wish to opt-out of our sharing your personal information with third parties for marketing purposes, please follow the unsubscribe instructions provided in any of the e-mails through our services, or notify us at info@thechromabooth.com.

DO NOT TRACK SIGNALS

Most web browsers and some mobile operating systems include a Do Not Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. Because there is not yet a common understanding of how to interpret the DNT signal, our website currently does not respond to DNT browser signals or mechanisms.

THIRD PARTY COLLECTION OF PERSONAL INFORMATION ABOUT YOUR ONLINE ACTIVITIES OVER TIME AND ACROSS DIFFERENT WEBSITES

In the future, we may partner with third party service providers who may collect information, including personally-identifiable information, about your online activities on our website and on and across different websites before you enter and after you leave our website.  Other third parties may also be tracking your online behavior across the Internet and over time. This Privacy Policy does not apply to information collected by these third parties.

CHANGE OF CONTROL

If Chroma, and/or substantially all of its assets, is acquired by another company or person, our user information will be one of the assets transferred or acquired by the purchaser.  You acknowledge that such transfers may occur, and that any purchaser of Chroma or its assets may continue to collect, use and disclose your personal information as set forth in this Privacy Policy.

THE CHILDREN'S ONLINE PRIVACY ACT

Our Services are not directed to children under 13 and we do not knowingly collect personally identifiable information from children under 13.  If we learn that we have collected personally identifiable information of a child under 13 we will take steps to delete such information from our files as soon as possible.
